Tom, will your insurance go up or will you lose your discount for no claims filed within a certain # of years?  I contacted my insurance, Allstate, for the 1200 bucks in damage since the uninsured deadbeat neighbor in my small town did not have any money when he hit my truck.  I went to small claims court, since my perfect driving record filing an uninsured motorist under my insurance would have lost my 10% discount, won my case for the 1200 bucks, and filed for a small fee paperwork to send into the Dept. of Transportation/DMV and took his drivers license away for 1 year until he settled with me by a certain date (a few months) since I had written proof from court he owed me the money (and he also had no estate to settle-deadbeat loser with no money or equity to take).  Right before the date was up to pay me, he called and we settled since he took out his retirement savings he had to pay me and get more out of debt.  I was just about ready to file with DOT/DMV paperwork after that date to take his drivers license away for 20 years until paid in full.  You can do that and I suggest you do that as well for maybe fear of no drivers license for either 1 or 20 years until she settles with you will get her motivated to pay you?  It worked for me, but took 8 months to finally pay me since he kept brushing me off telling me he would have the money in a month, then called and said another month, etc..  I finally said by the end of this month or going to small claims court.  I went to small claims court eventually and all was well.  I also found out you can deduct her wages thru court actions for a small fee if she has a job (might want to do that also), but the guy who hit me was on unemployment and had no job and you cannot take a person's unemployment money from them. 

Good luck any way you go and I feel your pain since I went thru it as well, but my pain was more emotional and sounds like you got physically hurt also which is twice as bad.  Best of luck and keep up your chin even though I know it can be very frustrating emotionally as well as physically for you. cool

That may be.  But, if you follow Oss's advice, you have recourse against YOUR insurance company.  Follow his advice.
 He knows his stuff.

Just a quick update:  It has been 16 days since the accident.

 PROGRESSIVE Insurance company has dropped the ball big time!!!

I am hoping it is an isolated incident. I have called them about every other day. I have given them a detailed itemized list of replacement parts needed for repairs and my painters estimate for body work and labor.

There was nothing else for them to do but to approve it and write a check or dis approve it.

They  have for two + weeks not even made an attempt to locate this women or the owner to find out if they are insured are not.  On the few times I was able to get them to call me back the excuses were that they had temporarily LOST MY REPORT AND PAPERWORK and that was the reason for the delay.

After discussing it with an attorney last week and we did some research while sitting in his office to find out that the women has been involved in a accident last year and was already being sued by PROGRESSIVE /my insurance company which means she didn't have coverage last year. 

You would think that would pop up for them if they were doing any research at all.  So now after finally getting in touch with my adjusters boss the excuse was that they thought I didn't want them to pay the claim but to wait to see what the women did. 
 
I made it very clear to them that I wanted them to repair my bike and then go after her to re-coup their money.

Well if things don't start happening here pretty quick if they don't drop me I will be dropping them  when this is over.

I have Progressive and when I hit a deer in 2006, I really have to say that I couldn't have been more pleased with the service they gave me.  They were very quick to sendout an adjuster and pay my damages, even when I submitted a supplement for additional money for damages found upon tearing the bike down.  I had the first check within 2 days, and they printed the 2nd check while I waited.  But then again, there were no other parties involved...which is what seems to be holding up your claim.  I hope you get it worked out quickly.

+1 Bob's experience was mine also

They paid me enough to buy a newer Valk with only 3k on it in 2003

Just got off the phone with the adjuster.

The check is in the mail after I had called and raised a bit of sand with his boss this AM.

I will give them the benifit of the doubt that it was a mis-communication.

Glad you'll be getting a check very soon and up and running hopefully before mid-summer just in time to get some good riding in yet this year.  Sometimes you have to do what you did and go higher up the ladder to get someone motivated to do their job.  I just hope your insurance rates do not go up because of the accident being the dumb ladies fault.  Sock it to her if your insurance company doesn't either way.  Drunks and deadbeats at least with no liability insurance should not be allowed the priviledge to share the road with others who have to pay these outrageous premiums.

It sounds like their pre-existing battle with your same lady may be involved in the fiasco.  No excuse for not giving you straight communication, though.  I've had them since buying my Valk new and have had two claims.  One involved a deer and the other, a road hazard.  I couldn't have been more pleased in both cases.  Sounds like the key is not to involve other people in your accidents!
